Telcom.Net Terms of Service
•Telcom.Net is an interactive online
service which provides Web advertising, and site services. This Agreement sets
forth the terms and conditions which apply to the use of Telcom.net’s services
by the Subscriber (customer), and Subscriber is deemed to have agreed to comply
with said terms by use, implementation, or agreement of the service.
•Subscriber represents and warrants that Subscriber has sole and exclusive rights
and ownership in any and all materials provided by Subscriber to Telcom.Net
for use by Telcom.Net in the design or modification of Subscriber's web site,
including but not limited to brochures, photographs, text, graphics, etc. contained
in such materials. Subscriber further warrants that the express consent of any
third party is not required for Telcom.Net to utilize the materials provided
by Subscriber in the creation of a web site for Subscriber. Subscriber agrees
to defend, indemnify and hold harmless Telcom.Net, its affiliates, directors,
officers, employees or agents for all damages and claims that may arise as a
result of entering into this agreement.
•All services provided by Telcom.net will be billed on a monthly basis in advance,
and will include all applicable Federal, state and local taxes, plus any one
time or special charges. If the subscriber utilizes any Telcom.net provided
service that has additional hourly, minute, or usage charges, these charges
will be billed at the time of the next monthly invoicing. Credit card authorized
payments will automatically be billed in similar manner. Payments not received
within 30 days after invoice date will be subject to a 1.5% finance charge,
and Telcom.net reserves the right to terminate or interrupt service at this
time. First time billing must be paid upon receipt, or service can be terminated
immediately. A returned check charge of $25.00 will be applied for any NSF checks.
•All billing disputes must be received by Telcom.net at its business office
in writing or electronic mail, and the obligation to pay for service will continue
until a cancellation has been received. Termination of service does not constitute
relief from amounts owed prior to termination or by contract. Contracts or agreements
on a monthly basis can be canceled in writing, but Subscriber will be obligated
to pay monthly fees already billed for the billing cycle which they cancelled.
No monies on semi-annual or annual billing will be refunded after 1st month
of service.
•Telcom.net makes no warranties of any kind, either expressed or implied, for
service provided. Telcom.net is not responsible for any damages you may suffer
from the use of our services, including, but not limited to, loss of data, service
interruptions and delays, or third party litigation.
•Telcom.net cannot and does not control the content of information available
through the Internet. For this reason, the Subscriber certifies that he or she
is at least 18 years of age and if the Subscriber is a parent or guardian, assumes
all responsibility for supervising the activities of an underage user. In addition,
any information obtained through Telcom.net is at your own risk.
•Subscriber shall use Telcom.net for lawful purposes only. Subscriber shall
not post or transmit through Telcom.net any material which violates or infringes
upon the rights of others, which is unlawful, threatening, abusive, defamatory,
invasive of public or private rights, vulgar, obscene or otherwise objectionable,
which encourages conduct that would constitute a criminal offense, give rise
to civil liability or violate any law.
•Attempts to gain unauthorized access to other computer systems is prohibited.
Users must comply with the rules and regulations of the network they access
through Telcom.net. Subscriber agrees to defend, indemnify and hold harmless
Telcom.net, its affiliates, directors, officers, employees or agents for all
damages and claims that may arise from the Subscriber's use or misuse of the
service which damages either the Subscriber, Telcom.net or a third party.
•Subscriber shall not intentionally allow unauthorized connections to Telcom.net,
unauthorized reselling of Telcom.net, or the solicitation of Telcom.net users
to become subscribers of other online information services competitive with
Telcom.net, nor shall Subscriber in any way duplicate any Telcom.net materials,
advertising, brochures, pamphlets and the like or any other information which
is proprietary to Telcom.net.
•Telcom.net shall have the right to change or modify the terms and conditions,
rates and services at any time. Such changes, modifications or additions shall
be effective immediately upon written, electronic notice and/or posting on the
Internet. Any use of Telcom.net by Subscriber after such notice, shall constitute
acceptance of the same.
•The relationship between Telcom.net and the Subscriber is that of a service
provider and a Subscriber only, accordingly, in the event of a violation of
any terms and conditions set forth in this Agreement by the Subscriber, Telcom.net
may immediately terminate the services provided to the Subscriber with the Subscriber
being fully responsible for all financial obligations described herein above
and with the Subscriber being additionally responsible for any and all attorney's
fees incurred by Telcom.net with regard to this Agreement at all trial and appellate
court levels.
•In the event of any dispute hereunder, Telcom.net and the Subscriber agree
that the venue for such dispute shall be Dade County, Florida and that the terms
and conditions of this Agreement shall be interpreted under the laws of the
